These Terms of Use set out the conditions under which you may use immomax.ch. We have kept them as short and as readable as we can — please read them anyway before you open an account or publish a listing.
1. Scope and operator
immomax.ch (the "platform") is operated by Swiss Max Group LLC. Full details of the operator — company name, address and registration number — are set out in the Imprint.
These terms apply to every use of the platform: to simply searching as much as to accounts, saved searches, listings you publish yourself and paid services. By using the platform you accept them. If you do not agree with them, please do not use the platform.
Differing or additional terms put forward by users apply only if we have accepted them expressly and in writing.
2. What immomax is — and what it is not
immomax is a search and information portal for property in Switzerland. We bring listings together from several origins: data feeds supplied by our partners, publicly visible listings on other portals, and listings published directly with us. Where the same property appears on several portals, we bundle it into a single result and show you where it was found.
We also enrich listings with data of our own — the municipal tax burden, public-transport access, information about the building. These enrichments are indications, not warranties.
immomax is expressly neither a landlord, seller, broker nor agent for the properties listed. We rent out nothing and sell nothing. Any contract about a property is concluded solely between you and the person or company offering it; immomax is not a party to it and earns no commission from it.
For aggregated listings, getting in touch always leads to the original source, where that source's own terms apply. We deliberately provide no contact channel of our own for third-party listings.
3. Permitted use
Using the platform to search, privately or professionally, is free and permitted. Any use that disrupts our operation or infringes the rights of others is not.
- no automated bulk extraction (crawlers, scrapers, bots) beyond ordinary use or placing a noticeable load on the service;
- no circumventing technical protections, access controls or rate limits;
- no building a competing offering out of content systematically taken from our platform;
- no use of the contact details shown for advertising, cold outreach or address trading;
- no unlawful, deceptive, discriminatory or harassing content or conduct;
- no attempt to defeat security measures, take over other people's accounts or distribute malware.
3.1 Technical interfaces
We offer a documented interface for machine use. If you want data on a regular basis, write to us via the contact form — for both sides that is a steadier arrangement than a crawler.
4. Your account
You can search without an account. Saved searches, favourites, your own listings and the apps require a free account.
To open an account you must have legal capacity; minors need the consent of their legal representative. The details you give when registering must be true and current. An account is personal and may not be transferred.
You are responsible for keeping your credentials confidential. We strongly recommend enabling two-factor authentication or a passkey in your account settings. If you suspect misuse, please tell us immediately.
You can delete your account at any time. We may block or delete an account where these terms are seriously or repeatedly breached, where we suspect misuse, or where we are legally required to; for minor breaches we will warn you first where that is reasonable.
5. Saved searches and notifications
A saved search tells you about new listings matching your criteria, by e-mail and — if you turn it on — by push notification. You set the frequency and the quiet hours yourself.
You can pause, change or delete any saved search at any time, and every message carries an unsubscribe link that works without signing in. Once you unsubscribe, we send nothing further for that search.
A saved search is a service, not a promise of completeness: we cannot guarantee that every matching property is captured, nor that every message arrives in time. Do not rely on it alone for time-critical decisions.
6. Listings you publish
If you publish a listing yourself, the following rules apply in addition.
6.1 Verification and accuracy
Before publication we verify your mobile number by SMS. Your details must be truthful, complete and current, and the property must genuinely be available. Photos must show the property being advertised.
6.2 Rights in your content
You may upload only text and images you hold the necessary rights in. You grant us a non-exclusive right, unlimited in time and territory, to store, adapt (crop, compress, watermark), translate and display them in the course of operating immomax — including in our apps, in saved-search messages and to promote the platform. Your copyright remains yours. Once you delete the listing we stop using them; technical residual copies (caches, backups) expire with their ordinary lifecycle.
6.3 Listings we do not allow
- properties that do not exist or are not available;
- misleading statements about price, area, condition or location;
- discriminatory wording, in particular as to origin, religion, sex, sexual orientation, disability or family status;
- listings that are in truth advertising for other services;
- posting the same property repeatedly to influence the ordering of results.
6.4 Review and removal
We review listings on a sample basis and whenever they are reported, and may change, hide or delete them without notice where they breach these terms or the law. Private accounts have a maximum number of simultaneously active listings, shown during the publishing process.
7. Aggregated listings, sources and timeliness
The content and accuracy of third-party listings are the responsibility of the source concerned, or of the person or company advertising. For every listing we state where the data came from and link there for contact.
We refresh our data continuously and show when a listing was last confirmed. Even so, a property may already be taken before the source withdraws it. The details at the original source always prevail.
If you spot an error, or a property is no longer available, please tell us through the contact form or with "Report listing" on the listing page. We correct or remove affected entries promptly.
8. Paid services
Searching, saved searches, favourites and private listings are free. Only clearly marked additional services are chargeable — in particular visibility options for professional advertisers, such as preferred placement in result lists.
Prices, what is included and the term are shown before you commit. All prices are in Swiss francs; whether and how much VAT applies is shown during checkout. The contract is concluded when you confirm your order.
Payment is handled by our payment providers. Invoicing and payment terms follow what is shown at checkout. If payment is overdue we may suspend the service.
Swiss law provides no general right of withdrawal for contracts concluded electronically. A booked service that has already been delivered is therefore not refunded. If we cannot deliver a paid service for reasons within our responsibility, we refund the unused portion.
Preferred placement is identifiable as such. It affects the order of results, not whether their content is correct, and it does not alter your search filters.
9. Reports, misuse and complaints
Please report listings that look fraudulent, unlawful or misleading using "Report listing" or the contact form. Our Safety tips describe the usual scam patterns.
Anyone claiming that content infringes their rights (copyright in photographs, personality rights, trade marks) should write to support@immomax.ch, identifying the listing concerned and the legal basis as precisely as possible. We examine every complaint, hide disputed content while we do so where that is proportionate, and remove it where the infringement is made out.
Every source can be switched off individually at our end. A well-founded complaint about a source can therefore be acted on immediately.
10. Rights in the platform's content
The design, software, text, logos and the analyses and enrichments we produce are protected. Any use beyond ordinary viewing and sharing of individual listings — in particular systematic incorporation into an offering of your own — requires our consent.
Content in third-party listings remains subject to the rights of its respective owners. Its display on immomax confers no right to use it.
The "immomax" name and logo may not be used without our written consent; simply naming us, for instance in an article or a link, remains permitted.
11. Availability and changes to the service
We operate immomax with customary care, but we do not owe any particular level of availability. Maintenance, failures at upstream providers or force majeure may cause interruptions.
We may develop, change or discontinue features. Material changes to paid services are announced to those affected in advance.
12. Liability
To the extent permitted by law, our liability for slight negligence is excluded, as is liability for our auxiliary persons. Liability for intent and gross negligence, and for personal injury, is not excluded; mandatory liability, in particular under the Product Liability Act, is reserved.
In particular, we are not liable for the content, accuracy, timeliness or lawfulness of third-party listings, for the conduct of other users, for contracts you conclude with advertisers, or for lost profit or a property you did not get.
The enriched data — tax burden, travel times, price comparisons, building information — are based on external sources and model calculations. They are for orientation and do not replace your own checks; for decisions of economic significance, the official or contractual figures prevail.
If you culpably breach these terms and a third party proceeds against us as a result, you will indemnify us against the resulting claims and reasonable costs of legal defence.
13. Data protection
How we handle personal data is set out in our Privacy, which forms part of these terms.
14. Changes to these terms
We may amend these terms, for instance when features change or the law does. The current version is published on this page with its date and version number.
We announce material changes to registered users at least 14 days in advance, by e-mail or when they sign in. If you continue to use the platform after that, the new version is deemed accepted. If you do not agree, you may delete your account free of charge before it takes effect; for services already paid for, the version in force at the time of booking applies.
15. Final provisions
If any provision of these terms is invalid, the remainder stays in force; the invalid provision is replaced by a permissible one that comes closest to its commercial purpose.
We may transfer our rights and obligations under these terms to a legal successor as part of a transfer of the business; your rights are unaffected.
These terms exist in German, French, Italian and English. In the event of discrepancies, the German version prevails.
16. Governing law and place of jurisdiction
The relationship between you and immomax is governed exclusively by Swiss law, excluding its conflict-of-law rules.
The place of jurisdiction is Zurich, Switzerland. Mandatory places of jurisdiction are reserved — in particular, consumers may always sue and be sued at their own domicile.
